BOOKING TERMS AND CONDITIONS AGREEMENT (PART 1)

I. Mandatory Information You Must Know and Understand

Documents: US Passports valid for at least 6 months from the date of departure are mandatory for US citizens when traveling to all foreign countries. The exception is Mexico where a valid drivers license can be combined with one of the following: original birth certificate with seal, US military ID, or notarized affidavit of citizenship. Visas are mandatory for US citizens traveling to Australia, Brazil, Papau New Guinea, and Indonesia (for stays of over 30 days).

IMPORTANT: For Non US Citizens (foreign nationals) many countries require visas to enter. It is critical that you consult the Consulate offices of the destination country in order to verify the visa requirements for you to enter that country, and this must typically be done well in advance of travel as some visas can take up to several weeks to obtain.

Airline tickets: Unless arranged otherwise, Wavehunters Surf Travel, Inc., sells promotional, bulk, or wholesale airline tickets which are the most restrictive in refundability, transferability, and changeability. Most tickets are non-refundable and non-transferable. Wavehunters Surf Travel, Inc. recommends purchasing travel insurance in order to protect yourself should you have purchased non-refundable tickets and need to cancel your trip for an unforeseen medical reason.

Surfboards: IMPORTANT- Many airlines charge excess baggage fees for surfboards. Some airlines such as United, Continental and Delta most notably have EXCESS BAGGAGE EMBARGOS to many cities meaning they do not allow surfboards at all on the plane during select times of the year to select cities. Becuase traveling with surfboards has become a complex matter, we urge you to allow Wavehunters to arrange your airfare and NOT TO ATTEMPT TO BOOK AIRLINE TICKETS ON THE INTERNET OR THROUGH OUTSIDE AGENCIES AS THEY WILL NOT TAKE AIRLINE BAGGAGE POLICIES PERTAINING TO SURFBOARDS INTO CONSIDERATION WHEN BOOKING YOUR TICKETS. Wavehunters will ensure that you are booked on a "SURF-FRIENDLY" airline. Please inquire with your Wavehunters agent about the particular baggage policies of the airlines on which you are booked. Wavehunters sells travel insurance with baggage loss and damage coverage which will insure your baggage and surfboards up to $1500.00 (see below).

Travel Insurance: Wavehunters Surf Travel, Inc. offers comprehensive travel insurance through Access America which includes coverage for the following: trip cancellation & interruption, baggage delay, baggage coverage, travel delay, emergency medical and dental, emergency medical transport & evacuation, and travel accident insurance. This insurance is COMPULSORY for all Wavehunters tours. Policies typically range in cost from $40 to several hundred dollars per person depending on the amount and duration of coverage.

Vaccinations: The Center for Disease Control maintains updated, expert information on this subject. Please review their website at: http://www.cdc.gov/travel/destinat.htm Malaria precautions are compulsory for travel to Indonesia and Papua New Guinea.

BOOKING TERMS AND CONDITIONS AGREEMENT (PART 2)

I. DEPOSIT, PAYMENT, CANCELLATION/REFUND, AND DISPUTE PROVISIONS

DEPOSITS: All deposits and trip payments are non-refundable. Most cancellations due to medical reasons or family emergencies are covered by travel insurance. On some tours we offer "rainchecks". This is done on a case by case basis.

PAYMENT: Full payment on all Wavehunters Surf Travel, Inc. tour bookings is required in our offices no later than 60 days prior to departure (90 days on boat charters). Tour bookings made within 60 days of departure (within 90 days on boat charters) require full payment at time of booking.

CREDIT CARDS: For all Wavehunters tours cardholders must submit a credit card authorization form either online or by fax or mail. We do not accept credit card payments over the phone. We do not accept 3rd party credit cards except from an immediate family member or from a known corporate customer. We accept Visa, Mastercard and Discover only.

CANCELLATION/REFUND POLICY: International surf tours, resorts, camps and boat charters are operations for which space is limited and competitive. All Wavehunters foreign suppliers are prepaid 30-90 days prior to departure so that they may begin provisioning for your tour. ALL TOUR PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE. Rain checks will be considered on a case-by-case basis if sufficient notice (at least 7 days prior to trip) was received of cancellation. There are no refunds or partial refunds given for early departures from a tour or early checkouts from a resort, hotel or surf camp. There are ABSOLUTELY no refunds given for reasons pertaining to surfing conditions or weather conditions. There are ABSOLUTELY no refunds given for reasons pertaining to a global, national, or provincial political situation that does not directly pose a security threat to the safe operations of the tour in the specific region. For your protection, travel insurance is mandatory with all Wavehunters tours.

DISPUTES: All claims, legal and otherwise, against Wavehunters Surf Travel, Inc., its officers, directors, agents, employees, affiliated companies, heirs and assignees arising under, in connection with, or incident to this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS 1, 2 AND 3, shall be determined according to the laws of California, United States of America and shall be adjudicated in the Courts within the jurisdictional geographic boundaries of San Diego County, California, United States of America, to the exclusion of the courts of any other county, state or country.

In the event that one or more of the provisions of this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS 1, 2 AND 3, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision within this agreement and this agreement shall be construed as if such invalid or unenforceable provision had never been contained herein.

BOOKING TERMS AND CONDITIONS AGREEMENT (PART 3)

WAIVER OF LIABILITY AND RIGHTS

WHEREAS: Wavehunters Surf Travel, Inc., hereinafter WSTI, is a booking agent which provides tours, trips and travel packages which are sports oriented, and

WHEREAS: WSTI has no ownership interest in, or control over, the management and/or operations of the tours, trips and travel packages it offers, and

WHEREAS: The parties hereto acknowledge that the services provided by WSTI involve surfing, swimming, diving, fishing, boating and water crafting, and other like activities, all of which have inherent risks and are potentially dangerous, and

WHEREAS: The parties hereto also acknowledge that travel to, and within, remote areas in the United States and elsewhere and to, and within, all foreign countries, especially third world countries, involves inherent risks which are also potentially dangerous, and

WHEREAS: The inherent risks and potential dangers referred to above may result in damages including, but not limited to, property damage or loss, personal injuries and/or death, and

WHEREAS: The undersigned has been advised to seek independent legal advice regarding the consequences of this Waiver of Liability and Rights, and has been given the opportunity to do so,

WHEREAS: The parties agree that weather and other natural conditions are beyond the control of either party hereto,

WHEREAS: The undersigned, being fully apprised of the above, none-the-less wishes to participate in one, or more, of the services provided by WSTI,

NOW, THEREFORE, for adequate consideration, receipt of which is hereby acknowledged,

(1) The undersigned hereby WAIVES ALL CLAIMS, and RELEASES AND AGREES TO HOLD WSTI HARMLESS for, or from, all damages, whether to the person or property of the undersigned, and
(2) AGREES to INDEMNIFY WSTI for any claims or obligations arising from the negligence of the undersigned while participating in any services provided by WSTI, and
(3) AGREES to HOLD HARMLESS and RELEASE WSTI FROM ALL LIABILITY resulting from all unsatisfactory surfing conditions, inclement weather, adverse climate conditions, and/or other natural conditions beyond the control of WSTI which may adversely impact the services provided by WSTI or the expectations of the undersigned.

Wavehunters Surf Travel, Inc. is a registered California Seller of Travel, C.S.T. Registration # 2060272-10, and does its ARC airline ticketing through CWT/Your Travel Center, an ARC approved travel agency.
